Caselaw With Appeal: A Discussion About the Law You Want to Know

Torys’ Appellate Group is excited to present their commentary on interesting developments from the appellate courts to the CLHIA.

 The panel will discuss: 

  1. Imperial Oil Limited v. Haseeb and the question of what personal information employers can request as part of the hiring process;
  2. What Murray-Hall v. Quebec tells us about federalism and the rights of Canadians to grow their own cannabis – and how this is relevant to the insurance industry; and 
  3. Safavi-Naini v. Rubin Thomlinson LLP and when a court will dismiss a claim against an employer arising from a workplace investigation.

A-1: Fairness to Customers: Pursuing a Fair and Balanced Approach

Interactions between the insurer and the insured don’t always go as planned. The concept of fairness — and how to embody it — almost always involves scrutiny of the conduct of the insurer.  Fairness, and how it plays out, can be pivotal in whether the relationship emerges unscathed, or survives at all, particularly after conflict.  This ultimately requires insurers to adopt and promote a fair and balanced approach when dealing with its stakeholders.

A-2: Anti-Fraud Litigation: How to Build your File

In this workshop, the presenters will review some of the lessons learned from recent benefits fraud litigation. They will also provide insight into the best ways to register a complaint with and how to enlist the support of regulatory colleges. 

A-3: What in the World is Going on with Total Cost Reporting and Segregated Funds?

The workshop will discuss the final Total Cost Reporting rules, the harmonization between insurance and securities industries and key challenges and issues for implementation. This will be an interactive session with viewpoints from both industry and CLHIA.

B-1: Recent Trends in Life and Disability Claims: The Changing Landscape

The last decade has resulted in significant changes in Life and Disability litigation.  At this workshop we will review recent trends in damage awards, the prevalence of jury notices, use of surveillance and demands for increased legal costs and disbursements.  We will review the quantum of recent damage awards and what we might expect going forward.  We will also discuss the risks and benefits of obtaining surveillance approaching trial whether it is to be tried by a jury or judge alone.  Finally, we will discuss the recent decision of Vella J. awarding full indemnity costs in Baker v. Blue Cross and how this may result in a new obstacle with respect to resolving disability claims.   

B-2: Top of Mind Issues in Quebec - This session will be conducted in French only.

The following three issues will be discussed in depth: 

  1. Bill17: the impacts for the group insurers: main modifications regarding disability benefits from RRQ that will become partly disability pension and partly retirement pension as on January 1st, 2024;
  2. Managing unclaimed properties: what is new and in progress in Quebec?
  3. Charter of the French Language: in force since June 1st, 2023: new obligation for Insurers related to section 55.

This session will provide an overview of certain recent legislative, regulatory and case law updates across the country with regard to pension plans and other saving schemes. It will also discuss certain trends and other developments affecting these plans and schemes.
