Law 25 In 2024: Data Portability Right and Anonymization

 

The right to data portability is the last of the individual rights provided by Law 25 to come into force, on September 22, 2024. We will discuss what this right entails for Canadian insurers and, in practice, what they should be putting in place to ensure compliance. Québec was also the first jurisdiction to enact a regulation specifically regulating the anonymization of personal information. This presentation will discuss how to navigate this important, but complex regulation.

Want to understand reinsurance, what it's for, how it works, how it's regulated, key documentation, and the special relationship between the insurer and the reinsurer?  We will cover the fundamentals of reinsurance, the different types of reinsurance common in Canada, ways of apportioning risks and practical tips on supporting your internal clients who deal with reinsurance arrangements. 

 

Workshop A-3 - Litigation Advocacy: Witness Examinations, Prepping Deponents, Production Requests

 

This workshop will involve a discussion about navigating the steps of litigation, with particular focus on issues and challenges which arise during the oral discovery process and assessing the need for and timing of expert reports.

This session will address the legislative and regulatory framework in Canada pertaining to the distribution of life and health policies in the digital space. We will review best practices and discuss areas of scrutiny, as well as new trends and opportunities. Nathalie will be presenting her portion of the presentation in French. 

 

Workshop B-2 - CLHIA Joint Provider Fraud Investigation Program: profile of successful collaboration

 

Did you ever think dreaming about fraud would put you on the right side of the industry………. if you did………. you are absolutely right!  Join Leila and Shannon as they share how mitigating benefit fraud has evolved over the years. Hear about the latest in sharing information and a behind the scenes look at the joint provider fraud investigation program.  You will even hear details and insights into closed cases.  Hear how we are an industry not just tackling benefits fraud but collaboratively tackling benefit fraud. 

 

Workshop B-3 - Importance of equity, diversity and inclusion concepts & cultural competence as part of negotiation and mediation

Workshop C-1 - Developing and Using Your Agility Quotient as In-house Counsel

 

In this session we will discuss how developing and improving your agility quotient (AQ) can help you to better navigate complex challenges and improve your overall effectiveness as a lawyer. Workshop C-2 - Dealing with Vexatious & Self Represented Litigants

 

This workshop will address issues relating to litigating claims with self-represented and vexatious Plaintiffs. We will discuss how to recognize a vexatious litigant, the standards for having someone declared a “vexatious litigant” and best practices for dealing with self-represented and vexatious Plaintiffs.   

 

Workshop C-3 - Pensions Law Update

 

A quick and practical Canada wide pension regulatory, legal and case law update with a look at the upcoming new CAPSA guideline 3 and the new rules allowing the disbursement of Québec LIFs.

Practical Concerns in the Wake of the Baker v. Blue Cross and Thomson v. ivari Decisions

 

This session features consideration of two recent decisions and will begin with an in depth look at the Thomson v ivari decisions, a brief discussion of earlier cases, and some important takeaways for consideration by the industry. The session will then take a deep dive into the nuances of the Ontario Court of Appeal decision in Baker v. Blue Cross which will include practical tips and considerations for both claims and litigation handling on a going forward basis.
